1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of ProspectIQ ("the Service"), operated by Driver Media Worldwide ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
ProspectIQ is a software-as-a-service (SaaS) platform that uses artificial intelligence to help users identify potential business prospects, score leads, find contact information, and generate personalized outreach emails. The Service aggregates publicly available information from third-party sources including Google Search and Google Places.
3. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use the Service. By using ProspectIQ, you represent that you meet these requirements. The Service is intended for business use only and is not directed at consumers.
4. Account Registration
You must create an account to use ProspectIQ. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
5. Subscription and Payment
ProspectIQ is offered on a subscription basis. By selecting a paid plan, you agree to pay the applicable fees as described on our pricing page. All fees are:
- Charged in US dollars on a monthly basis
- Processed securely through Stripe, our third-party payment processor
- Non-refundable except as expressly stated in these Terms
- Subject to change with 30 days' written notice
Free Trial: We may offer a free trial period. At the end of the trial, your subscription will automatically continue at the applicable rate unless you cancel before the trial ends.
Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for unused time.
6. Acceptable Use
You agree to use ProspectIQ only for lawful business purposes. You must not:
- Use the Service to send spam, unsolicited bulk emails, or messages that violate CAN-SPAM, GDPR, or other applicable anti-spam laws
- Harvest or scrape data from the Service in an automated manner beyond normal use
- Use the Service to harass, threaten, or harm individuals or businesses
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Share your account credentials with others or use the Service on behalf of unauthorized third parties
- Use the Service in any manner that violates applicable local, state, federal, or international laws
You are solely responsible for how you use the contact information and outreach emails generated by the Service and for ensuring your outreach complies with all applicable laws.
7. Data Accuracy
ProspectIQ pulls information from publicly available sources in real time. We make no warranties about the accuracy, completeness, or reliability of any prospect data, contact information, email addresses, or scores generated by the Service. You should independently verify contact information before use. We are not liable for bounced emails, incorrect contacts, or any consequences arising from inaccurate data.
8. Intellectual Property
ProspectIQ and all related software, designs, trademarks, and content are owned by Driver Media Worldwide. You are granted a limited, non-exclusive, non-transferable license to use the Service during your subscription term. You retain ownership of any data you import into the Service.
The FitScore™ methodology and AI-powered research engine are proprietary to Driver Media Worldwide.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRIVER MEDIA WORLDWIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
11. Indemnification
You agree to indemnify, defend, and hold harmless Driver Media Worldwide and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or any conduct we determine to be harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Massachusetts.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

1. Who We Are

2. Information We Collect
Account Information: When you register, we collect your name, username, email address, and password (stored securely).
Sales Profile: Information you provide about your business, products, ideal customers, and sales approach, used to personalize your ProspectIQ experience.
Usage Data: We log activity such as searches performed, emails drafted, and features used to improve the Service and provide analytics in our admin dashboard.
Payment Information: We do not store your credit card details. Payments are processed by Stripe, which has its own privacy policy. We receive confirmation of payment status only.
Prospect Data: Search results and prospect information you generate using the Service are stored in your account to power your pipeline. This data originates from publicly available sources.
Technical Data: Standard server logs including IP addresses, browser type, and timestamps for security and performance monitoring.
3. How We Use Your Information

- To process payments and manage your subscription

4. Data Storage and Security
Your data is stored in a PostgreSQL database hosted on Render's infrastructure in the United States. We use industry-standard security practices including encrypted connections (HTTPS/TLS) and secure credential storage. While we take reasonable measures to protect your data, no system is completely secure and we cannot guarantee absolute security.
5. Third-Party Services
ProspectIQ integrates with the following third-party services to deliver its functionality:
- Anthropic (Claude AI) — Powers our AI research and email drafting. Your sales profile and search context is sent to Anthropic to generate results.
- Google (Search & Places API) — Used to find prospect businesses in real time.
- Serper — Google Search API provider used for research queries.
- Stripe — Payment processing. Subject to Stripe's own Privacy Policy.
- SendGrid — Used to send password reset and transactional emails.
- Render — Cloud hosting provider where the Service and database run.
Each of these providers has their own privacy policies governing their use of data.
6. Data Retention
We retain your account data for as long as your account is active. If you cancel your subscription, we retain your data for 90 days to allow for reactivation, after which it may be deleted. You may request deletion of your data at any time by contacting us.
7. Prospect Data and Third Parties
The prospect contact information surfaced by ProspectIQ is aggregated from publicly available sources (Google Search, Google Places, public websites). We do not guarantee the accuracy of this information. Users are responsible for using this data in compliance with applicable laws, including CAN-SPAM, GDPR, and CCPA where applicable.

Depending on your location, you may have the following rights regarding your personal data:
- Access: Request a copy of the personal data we hold about you
- Correction: Request correction of inaccurate data
- Deletion: Request deletion of your account and associated data
- Portability: Request your data in a portable format
- Opt-out: Unsubscribe from marketing emails at any time

9. Cookies
ProspectIQ uses minimal browser storage. We use sessionStorage to maintain your login session during a browser session (cleared when you close the tab) and localStorage to store your prospect pipeline data locally on your device. We do not use third-party tracking cookies or advertising pixels.
10. Children's Privacy
ProspectIQ is not directed at children under 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, contact us and we will delete it.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance.
